HSE prosecuted a Rotherham employer today (30 March 2026) for failing to conduct a separate young persons risk assessment for a 17-year-old apprentice. Standard H&S assessments don't cover young workers under the Young Persons Regulations. Any employer with apprentices or under-18s is at risk.

Work at Height Regulations 2005. A ventilation shaft was covered only with plasterboard — a teenager fell through it to his death. Jerram Falkus was prosecuted by HSE on 18 March 2026 and fined £47,200. HSE prosecution is live. Every construction SMB with workers at height faces this risk. Plasterboard is not a safe platform.

PUWER Machinery Guarding — Employers Now Being Fined £140,000+

A Rotherham firm was fined £140,000 today after a 17-year-old apprentice was injured by a guillotine. PUWER Regulation 11 requires guarding on all dangerous machine parts — including gaps in machine beds. The company failed to identify the risk even after the incident. Any employer with cutting, pressing or forming machinery needs a PUWER risk assessment.

HMRC's Construction Industry Scheme: Three Simultaneous Changes

GPS loss = 20% deductions on all CIS income. For a £500k/year contractor, that's £100k/year impact — for 5 years. These changes affect every registered CIS contractor.

Change 1 — Critical

GPS 5-Year Bar

Gross Payment Status can be suspended for FIVE years (was 1 year) if HMRC believes you knew — or should have known — your supply chain was fraudulent. Loss of GPS means 20% deductions on all CIS income immediately.

Change 2 — Critical

NIL Returns Mandatory

Must file a monthly CIS return even in months with zero subcontractor payments. This requirement was previously removed — it's reinstated April 6. Failure triggers automatic penalties. First NIL return due 19 May 2026 (for April).

Change 3 — High

Supply Chain Liability

Ongoing subcontractor monitoring is now legally required, not just initial verification. Principal contractors must maintain records demonstrating continuous due diligence. Keep records for 6 years.
